Terms & Conditions of Purchase and Hire of Tummy Shield

These Terms and Conditions ("Agreement") govern the purchase and/or hire of the Tummy Shield product (the "Product") provided by 46 Life Pty Ltd t/a Tummy Shield Australia, ABN: 62 677 047 924 ("Company," "we," "us," or "our").

By purchasing, hiring, using, or allowing the use of the Product, you ("Customer," "Hirer," or "you") agree to be bound by this Agreement.

Part A: General Provisions

1. Product Description and Safety Warnings

1.1. Product Description: The Tummy Shield is a seatbelt repositioner designed to redirect the lap belt portion of a standard vehicle seatbelt away from the abdomen to the upper thighs and hips of an occupant.

1.2. Intended Use: The Product is intended for use in a vehicle with a three-point harness seatbelt.

1.3. Safety Warnings: The Tummy Shield is not a safety restraint device and is designed to be used only in conjunction with a properly functioning, three-point harness seatbelt in a motor vehicle. It is not a child safety seat or child restraint.

1.4. Acknowledgment: You acknowledge and agree that the Product does not replace the need for a standard vehicle seatbelt and must be used with a standard seatbelt.

1.5. Proper Use: You are responsible for ensuring the correct installation and proper use of the Product strictly according to the provided instructions. 

1.6. Mandatory Standards: The Company warrants that the Product complies with Australian Design Rules: ADR 5/04 for anchorages, ADR 4/03 for seatbelts, and ADR 69/00 for full frontal impact occupant protection.

Part B: Terms of SALE (Non-Hire)

2. Purchase and Delivery

2.1. Pricing: All prices are in Australian Dollars (AUD) and include the Goods and Services Tax (GST) unless explicitly stated otherwise.

2.2. Contract of Sale: A contract of sale is formed only when we accept your order by shipping the Product or providing you with an electronic confirmation of shipment.

2.3. Risk and Title: Title to and risk of loss or damage to the Product passes to you upon our delivery of the Product to the carrier.

3. Warranty and Returns Policy

3.1. Warranty: We warrant that the Product will be free from defects in material and workmanship for a period of 3 years from the date of purchase ("Warranty Period"). This warranty does not cover damage caused by accident, abuse, misuse, neglect, improper installation, or normal wear and tear.

3.2. 30 Day Money Back Guarantee: You may return the Product for a refund of the purchase price (excluding shipping fees) within 30 days of delivery, provided the Product is unused, in its original packaging, and in a re-saleable condition.

Part C: Terms of HIRE (Rental)

4. Rental Term, Fees, and Payments

4.1. Rental Term: The rental term is month-to-month, beginning on the date the first payment is collected. The term automatically renews each month until cancelled by the Hirer, up to a maximum term of 12 months.

4.2. Monthly Rental Fee: The recurring monthly rental fee is sixty dollars ($60.00) (the "Rental Fee").

4.3. Security Deposit (Bond): The Hirer must pay a refundable security deposit of three hundred dollars ($300.00) (the "Bond") prior to delivery.

4.4. Payment Failure: If a monthly payment fails, the Company reserves the right to suspend the agreement and demand immediate return of the Product.

5. Cancellation and Return of Hired Product

5.1. Cancellation Notice: The Hirer may cancel this agreement by providing the Company with 14 days written notice via email (support@tummyshield.com) prior to the next scheduled billing date.

5.2. The Hirer is responsible for arranging the return of the Product to the Company. The Company will cover the postage cost of this return. Upon receipt of the Hirer's cancellation notice (Section 5.1) and the mandatory Safety Survey (Section 6.2), a pre-paid postage label will be emailed to the Hirer to facilitate the return of the Product within the specified 7-day period.

5.3. Ownership Transfer Option: Upon successfully completing a continuous twelve (12) month rental term, the Product will be deemed purchased. Full legal ownership will automatically transfer to the Hirer, and the $300.00 Bond will be fully refunded.

6. Bond Refund and Inspection

6.1. Condition for Refund: The $300 Bond will only be refunded upon receipt and successful inspection of the Product and the completion of the mandatory Safety Survey.

6.2 Safety Survey: The mandatory Safety Survey is emailed upon conclusion of the rental to confirm if the Product was involved in any vehicle accident, collision, or airbag deployment. Completion is essential to verify the Product's integrity.

6.3 Deductions for Damage (Beyond Fair Wear and Tear): The Company reserves the right to deduct all or part of the Bond to cover damage that is not considered "Fair Wear and Tear". Fair Wear and Tear is defined as minor scuffing, slight fading of labels, or small non-permanent marks. Deductible damage includes: structural damage, cracks, deep scratches, missing/broken components, permanent staining, unauthorised repairs/modifications, or loss/theft.

6.4 Processing: Any eligible Bond refund will be processed within 14 business days after the Product has been successfully inspected and the mandatory Safety Survey has been received.

7. Accidents and Hirer Responsibilities

7.1. Immediate Notification: If the Tummy Shield is involved in an accident, collision, or any event resulting in airbag deployment or structural damage to the vehicle, the Hirer must notify the Company immediately.

7.2. Replacement: Upon proof of an accident during hire, the Company will arrange to send a replacement Tummy Shield. The Company will bear the cost of sending the replacement, and the Hirer will bear the cost of returning the compromised unit.

7.3. Care and Use: The Hirer is responsible for the care, security, and maintenance of the Product and agrees to use it strictly in accordance with the manufacturer's instructions.

7.4. Prohibition: The Hirer shall not modify, repair, sub-lease, or loan the Product to any third party.
