Part C: Terms of HIRE (Rental)

4. Rental Term, Fees, and Payments

4.1. Rental Term: The rental term is month-to-month, beginning on the date the first payment is collected. The term automatically renews each month until cancelled by the Hirer, up to a maximum term of 12 months.

4.2. Monthly Rental Fee: The recurring monthly rental fee is sixty dollars ($60.00) (the "Rental Fee").

4.3. Security Deposit (Bond): The Hirer must pay a refundable security deposit of ninety nine dollars ($99.00) (the "Bond") prior to delivery.

4.4. Payment Failure: If a monthly payment fails, the Company reserves the right to suspend the agreement and demand immediate return of the Product.

4.5 Recurring Payment Authorisation:
By entering into a hire agreement and providing payment details, the Hirer authorises Tummy Shield Australia to charge the agreed monthly Rental Fee to their nominated payment method on the scheduled billing date for the duration of the hire agreement, unless the agreement is cancelled in accordance with these Terms and Conditions.
The applicable Rental Fee, billing frequency, first payment date and any promotional arrangements will be disclosed to the Hirer before the hire agreement is confirmed.

4.6 Billing Errors and Missed Payments:
If Tummy Shield Australia identifies a billing or administrative error that has resulted in an agreed Rental Fee not being charged, being charged incorrectly, or being processed at $0, the underlying Rental Fee may remain payable unless it has been expressly waived or discounted.
Tummy Shield Australia will notify the Hirer in writing of any identified underpayment, including the amount outstanding, the relevant hire period and the reason for the error.
No additional catch-up payment arising from an administrative billing error will be debited outside the agreed billing schedule without first obtaining the Hirer's authorisation.

4.7 Recovery of Outstanding Rental Fees:
Where an agreed Rental Fee remains outstanding due to a billing error, Tummy Shield Australia may request payment of the outstanding amount.
The Hirer will be provided with a reasonable opportunity to review the payment information, raise any concerns and agree to a suitable payment date or arrangement.
Tummy Shield Australia will not charge interest or administrative penalties for underpayments caused solely by its own billing errors.
Any agreed catch-up payment will be separate from the Hirer's regular monthly payment unless otherwise agreed.

4.8 Promotional Offers and Discounts:
Promotional offers, free hire periods and discounts apply only to the rental periods and conditions expressly specified in the promotion.
Unless otherwise stated, the regular monthly Rental Fee will resume following the conclusion of the promotional period.
Any promotional discount will be confirmed at the time of hire, including the duration of the offer and the date on which standard billing will commence.
A billing error or incorrect $0 transaction does not, by itself, constitute an additional promotional discount or waiver of the agreed Rental Fee.

4.9 Payment Notifications and Records:
Tummy Shield Australia will provide the Hirer with confirmation of their rental subscription, including the applicable monthly fee, payment schedule and any promotional conditions.
Where a billing error requires an additional payment outside the regular billing schedule, written notification and payment authorisation will be obtained before processing that payment.
The Hirer may request a record of their rental payments and applicable subscription arrangements by contacting support@tummyshield.com.

5. Cancellation and Return of Hired Product

5.1. Cancellation Notice: The Hirer may cancel this agreement by logging into their Tummy Shield account and selecting Request Return. The Company reserves the right to continue the subscription if the Product is not sent within 7 days of cancellation.

5.3. Ownership Transfer Option: Upon successfully completing a continuous twelve (12) month rental term, the Product will be deemed purchased. Full legal ownership will automatically transfer to the Hirer, and the Bond will be fully refunded.
